📜 Terms of Service — Free plan

1. Who we are
ComIO.Studio is distributed by Sebastian Pietrasiak, ul. Patriotów 3A, 32-593 Żarki, Poland, email: info@comio.studio (the Operator).
These Terms apply to the ComIO.Studio desktop application, the website, and use of the Free plan.
2. Acceptance
By downloading, installing, registering, or using ComIO.Studio on the Free plan, you accept these Terms.
If you do not accept them, do not use the Application.
You must be at least 18 years old to use the Application.
3. Plan covered by these Terms
These Terms cover the Free plan.
The Free plan is free of charge. It does not require payment or a subscription.
On first launch or after local data is removed, the Application may register the device with the Operator’s licensing service and receive a Free session token. This token works like a technical pass for the device: it helps keep plan status, restore the session, handle updates, prevent abuse, and maintain service continuity. It is not a purchase or paid activation.
If the same device has an active paid plan, the licensing service may restore that plan instead of creating a new Free session. This lets the user recover access after local data is cleared, if the Application can safely recognize the device.
4. Free plan features
The Free plan includes core Application features, including:
- serial terminal with control lines and RX/TX counters;
- file logging;
- RX/TX data buffer in ASCII and HEX modes;
- M1–M6 macros;
- command bar and keyboard shortcuts;
- firmware programmer;
- theme management;
- application updates;
- an in-app information or promotional panel.
Features and modules from paid plans are not available in the Free plan.
The user may not independently extend the Free plan or unlock features intended for paid plans. The Free plan scope and the availability of specific modules follow the current Application version and Operator communications.
5. Information and promotional panel
The Free plan may include an information, promotional, or similar panel inside the Application.
In the panel, the Operator may show, among other things:
- product and release information;
- technical or organizational messages;
- information about paid plans;
- promotional content and advertisements (including those from third-party ad networks and providers);
- other content related to maintaining and developing the Application.
The panel is an essential part of the Free plan model and a condition for its free provision. Providing the necessary consents (e.g., for advertising cookies or tracking by third-party providers), if technically required to display the panel by the ad network, is a condition of using the Application in the Free plan. If you do not grant, withdraw, or block the mechanisms necessary to display the promotional panel, the Operator has the right to block or terminate your access to the Application in the Free plan.
The Free plan does not include an in-app setting to disable the advertising panel.
The Operator may change how the panel works, including the content source, display frequency, and ad providers.
6. Safety-critical use
ComIO.Studio can send commands, run macros, flash devices, and assist with debugging.
Do not treat ComIO.Studio, macros, commands, logs, or any Application output as a safety system.
You are responsible for testing every command, macro, configuration, and firmware operation before using it on real hardware.
Do not use ComIO.Studio as the only safeguard for machines, vehicles, medical systems, industrial systems, power systems, or any environment where failure could cause injury, damage, downtime, data loss, or legal breach. In such situations, use independent safety procedures and safeguards, such as emergency stops, access control, human authorization, and on-site verification.
7. No warranties
ComIO.Studio is provided “as is” to the maximum extent allowed by law.
The Operator does not guarantee that the Application, serial communication, flashing, macros, updates, website, licensing service, information panel, promotional panel, or third-party services will be error-free, uninterrupted, secure, available, or fit for a specific purpose.
You use the Application at your own risk.
Nothing in these Terms limits mandatory rights that cannot be excluded by law.
8. Your responsibility
You are responsible for:
- your devices, firmware, commands, macros, logs, settings, and files;
- backups before using the Application;
- checking outputs before using them;
- complying with law and third-party terms;
- using the Free plan without bypassing security, technical limits, or paid-plan boundaries.
You must not use the Application to break law, attack systems, bypass security, overload services, infringe rights, or endanger people, property, or equipment.
9. Limitation of liability
To the maximum extent allowed by law, the Operator is not liable for indirect loss, lost profit, lost data, downtime, device damage, production loss, or loss caused by third-party services.
The Free plan is provided free of charge. Where liability cannot be excluded, the Operator’s total liability towards a Free plan user is limited to the lowest level permitted by mandatory applicable law.
Nothing in these Terms excludes liability that cannot be excluded by mandatory law.
10. Intellectual property
The Application, website, brand, code, design, documentation, and related materials belong to the Operator or licensed third parties.
You receive only the right to use the Application in the Free plan according to these Terms.
You may not copy, resell, reverse engineer, remove protection from, or distribute the Application except where mandatory law allows it.
11. Updates and changes
The Operator may update the Application, website, information panel, promotional panel, Free plan features, technical limits, and these Terms.
For security, legal compliance, abuse prevention, critical bug fixes, or service continuity, the Operator may require or automatically apply critical updates. Older versions may be limited, blocked, or no longer supported if they create security, legal, technical, or abuse risk. A critical update may require application restart.
Material changes will be announced with reasonable notice where practical.
12. Termination
You may stop using the Application at any time.
The Operator may suspend or terminate access if you breach these Terms, misuse the Application, create security risk, bypass plan restrictions, or abuse the Operator’s infrastructure.
Sections about safety, liability, intellectual property, privacy, and disputes remain effective after termination.
13. Law and disputes
These Terms are governed by Polish law, without limiting mandatory consumer protection rights.
You may contact info@comio.studio before starting a formal dispute so we can try to resolve the issue. This does not limit any mandatory right to go to court or use another lawful complaint path.
